    The law is well settled.

    In NYTimes v. Sullivan, the Court held that when the speech concerns a public figure, it isn't even enough for it to just be false; there must have been reckless disregard for truth. . .

    Since all he cares about is the economy and re-election, let's hope for the country's sake that losing every challenge on this matter (it would be summary judgment at trial his position is so weak) gets him to realize that he needs to start acting differently and change the narrative, actually listen to all state's requests and fulfill them and not just doing his buddy down in Florida a solid.

    As per Dry, the nationwide polls mean nothing. Repeating something we've said before: Polling in about 40 states is totally irrelevant (the 40 that are most surely going one way or the other). It might be helpful to poll the 10 states closest to going either way. But even then, the statistics need to be shown for the individual states, not as a group.

    Bottom line: 2016 surely taught us the minimal or absent value of any of these polls, so even what I said above might be irrelevant.
